49ers plan to bring back QB Alex Smith for 2012 (AP)

SANTA CLARA, Calif. ? Coach Jim Harbaugh has told 49ers quarterback Alex Smith the team plans to re-sign him beyond this season.

Smith, the 2005 No. 1 overall draft pick out of Utah, received a $4.9 million, one-year contract as a free agent last July after the lockout ? when many, including Smith himself, figured he'd be headed elsewhere following six up-and-down seasons. He has thrived under Harbaugh, a former NFL quarterback who recently endorsed Smith as the team's answer behind center moving forward.

"I've told Alex that," Harbaugh said Monday. "I wouldn't tell you (the media) something I wouldn't tell Alex.

"I told Alex, `Hey, we're going to want you to come back here next year.' He's focused on the season, and that's where his mindset wants to be. And I totally respect that, and we'll talk about it and address it once the season is over. That's the way I understand it right now."

The 27-year-old Smith has thrown for 3,150 yards and 17 touchdowns with only five interceptions for the NFC West champion Niners (13-3), who earned the No. 2 playoff seed in the NFC and a first-round bye this week.

Smith is a big reason San Francisco finished with 10 total turnovers, which equaled the 2010 Patriots for fewest in NFL history since 1941.

Smith ? booed from every direction during recent seasons at Candlestick Park ? has said much of this season's success comes from him not trying to do too much in Harbaugh's West Coast offense.

He has shown the poise under pressure and decision making Harbaugh believed Smith still had in him when Harbaugh took over last January. Smith isn't ready to reflect on his resurgent 2011 season or the franchise's turnaround after going eight years without a playoff berth or winning record.

"You know, it's hard when you're still in the thick of it. It's probably a better question to ask me after the end of the season when everything is wrapped up," he said. "Right now there's still a lot on the line. Not quite time for me to reflect on anything. We've done some good things, putting ourselves in a good situation."

Smith, who has played for a different offensive coordinator in each of his seven NFL seasons, has earned the confidence of his teammates. He went 21 for 31 for 219 yards in Sunday's regular-season finale, a 34-27 win at St. Louis.

"I firmly believe that Alex Smith can do nothing but just keep getting better," said tight end Vernon Davis, who had eight catches for 118 yards against the Rams.

"At this point ... all he can do is get better. If he's willing and that's what he wants. He wants to be successful and learn as much as he possibly can about this game and try to find ways to help this team get better down the road. I'm all for it. I'm a big supporter."

This is a very early version of Stack Alert and it is far from complete. Although the basic functionality is in place, the error handling code needs some help and I would like to add a few other features before a final release.

Indefinite detention for terror suspects: Did Obama sell out? (The Week)

New York ? Progressive critics cry foul after the president signs a defense law enshrining the military's right to indefinitely hold al Qaeda suspects

President Obama signed a $662 billion defense bill on Saturday that includes GOP-authored provisions giving the military greater authority to detain terrorism suspects indefinitely ? even if they're U.S. citizens. Obama had threatened to veto the bill, and still has "serious reservations" about the detention rules. But Obama said Congress made last-minute changes that rendered the National Defense Authorization Act "minimally acceptable," and he vowed never to allow open-ended military detention of citizens without trial. Still, did Obama betray his progressive supporters?

No doubt about it. Obama sold out: "Thomas Jefferson must be spinning in his grave right now," says Michael Coard at Philadelphia magazine. Citizens have a constitutional right to a civilian trial ? and civilian courts have proven far more effective than military tribunals at convicting terrorists, anyway. Obama came into office rejecting the phony idea that we had to choose between our safety and our ideals. "What a difference [three] years make."

It's not perfect, but Obama improved detention laws: Civil liberties groups should be thanking Obama, say Marty Lederman and Steve Vladeck at Lawfare. Already, enemy forces can be held until hostilities end. If Obama had buckled and accepted the more extreme earlier versions of this bill, that authority would have been expanded. But he held out for changes, such as greater flexibility in transferring prisoners from Guantanamo, that "will be distinct improvements vis-a-vis the status quo."

The law still sets a dangerous precedent: It's good that Obama expressed discomfort with this bill's detainee measures, says David Dayen at Firedoglake. But "the problem with this bill was always about codifying of indefinite military detention into the law, available for any future president to pick up and use." And remember, the law's language is vague ? you can detain anyone "associated" with al Qaeda. That's a very slippery slope.

Chargers end Raiders playoff hopes with 38-26 win (AP)

OAKLAND, Calif. ? Philip Rivers threw three touchdown passes and Richard Goodman returned a kickoff 105 yards for another score as the San Diego Chargers ended Oakland's playoff hopes by beating the Raiders 38-26 on Sunday.

The Raiders (8-8) went into the final day of the season needing to win and get help to end an eight-year playoff drought. They got the assistance they needed when Denver (8-8) lost 7-3 at home to Kansas City but were unable to do their part by beating the Chargers (8-8). The Broncos won the division based on record versus common opponents.

The Chargers could only celebrate playing the role of spoiler in what may have been coach Norv Turner's final game in San Diego.

The Beer and Brats Cancer Diet

When I was first researching for what else to do about my lung cancer diagnosis besides the traditional means I would be taking, I kept running across all kinds of suggestions for changing diet as a way of beating cancer, usually quite dramatically. Among the horrible visions going through my mind were ones of flax oil in cottage cheese or quitting either all kinds of meat or even just leaving pork behind filtered through my head from time to time.

My thought finally was that probably these odd diets probably work for some people, particularly if they believe they will. Faith can certainly do wonders. However, with with my lack of faith in any of them, I would do well to just avoid them. There may even be a way of targeting such diets to just those cancer types that they may really help. However, until that day, I plan to continue with what I call with tongue firmly in cheek, ?The Beer and Brats Cancer Diet?.

On this Diet (or Procedure, as I sometimes call it), I also enjoy foods that don?t involve beer and brats. The important thing is to eat things that I do enjoy, particularly of a protein nature, such as steaks, roasts or chops, which would keep my weight up, or spicy, such as Indian or Jamaican food. However, salads are pretty cool too, especially with steak.

I am no expert, but in this diet I include supplements that are most likely to actually fight cancerthrough more than as a morale booster, such as turmeric, quercitin, grape seed extract (Resveratrol) and milk thistle for my liver. Then I can have a beer (and maybe a brat if I am hungry).

My first CAT scan after starting Tarceva shows the cancer to be stable and no indication of it still affecting the lymph nodes. However, with all the scar tissue from the radiation suggests to me that, if I beat the damned thing, I will never be quite sure of it.

My glass is certainly a lot more than half full. In addition to being married to a wonderful lady, I will still have the Beer and Brats Cancer Diet as long as I am healthy. Plus I get a lot of inspiration here, for which I am grateful. Special kudos go out to`both Marie and Art.
